Big Smoke social media pages terms

Effective from 1 September 2026

These Terms govern the use of the official Bigsmoke.kz pages on social networks, users' interaction with those pages, the publication of user content and the processing of personal data obtained through that interaction. By using the Pages, you confirm that you have read and accept these Terms.

1. General provisions

1.1. «Pages» means the official Bigsmoke.kz accounts and channels on social networks and online platforms that are run by IE «VR46» and linked from the Bigsmoke.kz website or expressly identified by us as official. Links to the official Pages are on the Contact page and at the bottom of every page of the website.

1.2. The Pages are intended for users in the Republic of Kazakhstan aged twenty-one or over. If you are under twenty-one, do not follow the Pages, do not interact with their materials and do not send us user content.

1.3. Because the Bigsmoke.kz range includes tobacco products, heated tobacco products, hookah and rolling tobacco, tobacco heating systems, hookahs, electronic bowls and other smoking devices and accessories, access to the Pages is limited to a 21+ audience whatever the category of a particular material.

1.4. The Pages are used to inform adult consumers, for support replies, to publish organisational information and to run the community. They are not intended for unlawful advertising, for encouraging demand for tobacco or nicotine-containing products, or for getting round restrictions established by law.

2. Who runs the Pages

2.1. The Pages are owned and administered by the individual entrepreneur Rustem Nurlanovich Mukhtarov, trading as IE «VR46», IIN 910605300019, hereinafter «we», the «Seller» or the «Administrator».

2.2. Names such as IQOS, TEREA, ENZO, X KAH and other brands appear on the Pages solely to identify the goods concerned. The trademarks belong to their owners. IE «VR46» is not the manufacturer of the goods, the owner of those trademarks or an official representative of the rights holder, unless this is expressly stated for a particular product or material.

3. Acceptance of the Terms and platform rules

3.1. You accept these Terms when you visit the Pages, follow them, like posts, publish comments, send direct messages, take part in discussions or otherwise interact with the Pages.

3.2. The rules, privacy policy and technical terms of the relevant social network or online platform apply at the same time. Where the platform's rules are stricter than these Terms, the user must comply with the stricter requirements.

3.3. A comment, direct message or other approach on a Page does not in itself count as placing an order or concluding a sales agreement, unless we have expressly confirmed otherwise. The sale of goods is governed by the applicable public offer and other Bigsmoke.kz documents.

4. Information about tobacco, nicotine and devices

4.1. Smoking and using tobacco or nicotine-containing products harm health and can cause addiction. The best decision for your health is to stop using tobacco and nicotine altogether.

4.2. Tobacco and nicotine-containing products, tobacco heating systems and related materials are not intended for persons under twenty-one, for people who have never used such products, or for people who have stopped using them.

4.3. Information on the Pages is not medical advice. The goods are not medicines and are not intended to treat nicotine addiction, unless this has been officially confirmed for a particular product.

4.4. Minors and pregnant or breastfeeding women should not use tobacco or nicotine. People with cardiovascular disease, diabetes or other conditions should take medical contraindications into account and consult a doctor if necessary.

5. Community rules

5.1. You are responsible for the posts, comments, images, audio, video, links, reviews and messages you publish. User content must comply with the legislation of the Republic of Kazakhstan, these Terms and the rules of the relevant platform.

5.2. It is prohibited to publish or send on the Pages:

• insults, obscene language, threats, bullying, harassment, calls to violence, or materials that damage honour, dignity or business reputation;
• discriminatory statements or materials inciting social, national, racial, religious or other hatred;
• sexually explicit materials, and images of or information about minors not related to a legitimate support request;
• other people's personal data, correspondence, details of their private life, confidential information or trade secrets without a lawful basis and the necessary consents;
• materials infringing copyright, related, exclusive or other rights of third parties;
• spam, hidden advertising, commercial offers, bulk repetitive messages, malicious links, viruses or other harmful code;
• impersonating another person or creating a false impression of a connection with Bigsmoke.kz, IE «VR46», a manufacturer, a rights holder or a public authority;
• offers to buy, sell, transfer or deliver goods whose circulation is prohibited or restricted by law, and instructions for getting round age checks, labelling, excise or other mandatory requirements;
• advertising, prize draws, contests or other actions aimed at encouraging demand for tobacco or nicotine-containing products where such actions are prohibited by law;
• knowingly false information about the properties, safety or health effects of products, including claims that they carry no risk or have a therapeutic effect;
• any other unlawful content, or materials unrelated to the topic of the Page that interfere with normal communication between users.

5.3. Do not post your ID number, IIN, bank details, full address, order number or other restricted information in public comments. To resolve an issue, support may suggest moving to direct messages or using an official contact channel.

6. Moderation

6.1. We may review user content, hide or delete it, restrict comments, close a discussion, block a user or report to the platform's administration if we believe these Terms, the platform's rules or the law have been breached.

6.2. Moderation measures may be applied without prior notice where the law and the platform's rules allow. We are not obliged to publish user content, explain an editorial decision or keep material deleted by the platform.

6.3. Moderation does not mean that we approve or endorse every material published by users. Users' opinions may differ from the position of IE «VR46».

7. User content

7.1. «User content» means any texts, reviews, photographs, images, audio, video and other materials that you publish on the Pages, tag with an official Bigsmoke.kz mark or hashtag, or send to us offering that we post, use or distribute them.

7.2. By providing user content for use, you confirm that:

• you are aged twenty-one or over;
• you are the author and rights holder of the content or have obtained all necessary permissions;
• the content does not infringe intellectual property rights, image rights, privacy, personal data protection or other rights of third parties;
• every recognisable person in the content is aged twenty-one or over and has allowed the photos, audio or video to be made, shared and used as agreed;
• granting the licence does not breach your obligations to third parties or the law;
• at our reasonable request, you can confirm that you hold the relevant rights and consents.

7.3. You keep your copyright and other rights. At the same time, you grant IE «VR46» free of charge a simple non-exclusive licence to use the user content to the extent set out in this section.

7.4. The licence allows us to reproduce, store, format, shorten, edit without distorting the meaning, translate, annotate, show publicly, make available to the public, post and distribute the user content on the Bigsmoke.kz website, the official Pages and our other information materials, where such use is permitted by law.

7.5. The licence is worldwide and royalty-free and runs from the moment the user content is provided until it is terminated as to future use. We may engage technical contractors and platform operators solely to carry out the uses described.

7.6. Together with the licence, you allow us to use your name or pseudonym, image, voice and the brief information you provided in connection with the user content concerned. Where this information is personal data, it is processed in accordance with the law and the applicable consent.

7.7. We may use content with or without crediting the author, unless the law requires otherwise. We are not obliged to publish content, keep it unchanged or return materials sent to us.

7.8. You may terminate the licence as to future use by sending a request to contact@bigsmoke.kz. Termination does not make unlawful any use made before the request was received and processed, and does not require materials to be removed from printed copies already issued, backups or archives, unless the law provides otherwise.

7.9. If you believe that your work, image, personal data or other protected material has been used unlawfully on a Page, send to contact@bigsmoke.kz a link to the post, a description of the infringement, proof of your rights and a way to contact you.

8. Privacy of personal data

8.1. When you interact with the Pages, we may receive your name or pseudonym, account ID, profile picture, the content of comments and messages, contact details, information about your enquiry and other information you provide voluntarily.

8.2. This data is processed to answer enquiries, support customers, moderate, ensure security, deal with claims, protect rights, publish agreed user content and comply with the law.

8.3. Processing is carried out under the Consent to the collection and processing of personal data and the Bigsmoke.kz Privacy and Consumer Personal Data Processing Policy.

8.4. The social network or online platform processes users' data itself under its own rules. We do not determine all the ways in which it does so and recommend reviewing the privacy settings of the platform concerned.

8.5. Do not send us more personal data than necessary or copies of documents through public comments. If information is needed to fulfil a request, use the secure or non-public channel offered by support.

9. Liability and disclaimer of warranties

9.1. The Pages are provided «as is» and «as available». The Pages depend on the platform concerned, internet access and third-party services, so we do not guarantee constant availability or the absence of errors, delays or technical failures.

9.2. We try to keep information up to date, but materials on the Pages may be incomplete or out of date. Before buying, rely on the information on the labelling and packaging, in the manufacturer's instructions, on the product page and in the applicable Bigsmoke.kz documents.

9.3. We are not responsible for user content, third-party links or the actions of other users, unless the law provides otherwise. Users follow external links at their own discretion and subject to the rules of the resource concerned.

9.4. The user bears the liability provided by law for content they publish and for damage caused through their fault. Nothing in these Terms excludes or limits any liability of IE «VR46» that cannot be excluded or limited under the legislation of the Republic of Kazakhstan.

10. Changes and termination of the Terms

10.1. We may change these Terms in line with the requirements of the law. A new version is posted on the Bigsmoke.kz website or on a Page and applies from the date it states.

10.2. Continuing to use the Pages after a new version takes effect means accepting the updated Terms. If you do not agree with the changes, stop using and interacting with the Pages.

10.3. We may stop running a Page in whole or in part, change its functions or move the community to another platform.

11. Governing law and final provisions

11.1. These Terms and the relations connected with them are governed by the legislation of the Republic of Kazakhstan. Disputes are heard in the manner and by the courts determined by the legislation of the Republic of Kazakhstan.

11.2. We may transfer our rights and obligations under these Terms to another person in the cases and manner permitted by law, provided this does not reduce the user's mandatory rights.

11.3. Failure or delay in exercising a right does not mean waiving it. If any provision is found invalid or unenforceable, the remaining provisions stay in force.

11.4. Where these Terms differ from mandatory legal requirements, the requirements of the legislation of the Republic of Kazakhstan apply.
