Hookah equipment rental terms

Effective from 1 September 2026

These Terms govern the rental of hookahs, electric charcoal heaters and accessories to individuals for personal consumer purposes. The specific set, rental period and price are recorded before the equipment is handed over in the Individual Order and the Handover Record.

Key terms. The refundable security deposit is 20,000 tenge. Tobacco, charcoal and other consumables are not included in the rental price. Equipment is handed over and returned only at the Big Smoke premises after its completeness and working order have been checked.

1. Parties and subject of the agreement

1.1. The Lessor is the individual entrepreneur Rustem Nurlanovich Mukhtarov, trading as IE «VR46», IIN 910605300019, hereinafter the «Lessor» or «Big Smoke».

1.2. The Lessee is an individual aged 21 or over who has entered into an individual rental agreement and accepted the equipment under the Record, hereinafter the «Lessee».

1.3. The Lessor provides the Lessee, for a fee, with movable property for temporary possession and use without transfer of ownership. The agreement is intended for personal consumer purposes. Rental for business purposes is arranged under a separate agreement.

1.4. The rented item is identified in the Handover Record, which states its name, model, serial or internal number, completeness, condition, and the period and area of use. Without this information, a request on the website does not confirm the handover of specific equipment.

2. Request and conclusion of the individual agreement

2.1. A request may be sent through Bigsmoke.kz, a manager, by phone or through an electronic interface introduced by Big Smoke. A request is a booking enquiry and does not in itself confirm that equipment is available or mean that an agreement has been concluded.

2.2. Before payment, the manager tells the Lessee the available set, the period, the place and time of handover and return, the rental price, the extension procedure and other individual terms. The price and period of an agreed order are not changed unilaterally once it has been confirmed.

2.3. The individual agreement is concluded in writing by signing the Handover Record, or in an electronic form permitted by law that makes it possible to identify the parties, the content of their intentions, the version of the terms, and the date and time of confirmation.

2.4. If a Telegram bot or other interface is introduced, a phone number, one-time code and event record may be used to identify and confirm actions only in a manner consistent with the law in force. Until such a procedure is introduced, the Record is signed by hand; an electronic code serves as additional confirmation.

2.5. The agreement for a specific set is deemed concluded once the manager has confirmed it, the individual terms have been agreed, the required payments have been made and the Handover Record has been completed.

3. Age and check of the recipient

3.1. Big Smoke hands over equipment only to the Lessee or a Recipient named by them who is aged 21 or over. The original identity document is shown before handover.

3.2. Handover is refused if there is no document, the person is under 21, there are signs of intoxication by alcohol or otherwise, or the person behaves aggressively or unsafely.

3.3. The document is not copied unless there is a separate lawful basis. It is enough to note in the Record that age was checked and the type of document shown, unless the law requires otherwise.

4. The rental set

4.1. A set may include a hookah, stem or body, base, tray, bowl, hose, mouthpiece, seals, balls and other valve parts, tongs, a bag or case, an electric charcoal heater, power cord, plug and other accessories listed in the Record.

4.2. Only the items expressly listed in the Record are handed over. Quantities, visible features, signs of ordinary use and photos are recorded before handover to separate the original condition from later changes.

4.3. A category being mentioned in these Terms does not mean a particular model is necessarily available. The set is confirmed by the manager when the order is placed.

5. Rental period and price

5.1. The rental price is set by the Lessor and communicated in tenge before the individual agreement is concluded. The agreed amount is stated in the Record and confirmed by a cash-register or electronic receipt or another document provided for by law.

5.2. The period starts when the set is actually handed to the Lessee or the agreed Recipient and ends when it is actually returned to a Big Smoke staff member. The planned date and time are recorded in the Record.

5.3. Extension is allowed only after the manager confirms it. The additional fee is calculated according to the rate or minimum billing period stated in the Individual Order before the equipment is handed over.

5.4. On early return, the price is recalculated if such a procedure and billing periods are stated in the Individual Order. The Lessee may stop using the set and return it at any time, paying the actual obligations under the agreement.

6. Security deposit

6.1. Before the equipment is handed over, the Lessee pays a refundable security deposit of 20,000 tenge. It secures the return of the set, payment for the agreed rental and extension, and the obligation to compensate proven damage.

6.2. The security deposit is not the rental price, an advance, a penalty or a booking fee. No interest accrues on it. It is not withheld automatically for any remark about the equipment.

6.3. If the set is returned on time, complete and without damage beyond its original condition and ordinary wear, the security deposit is refunded. A cash refund is made after acceptance; a non-cash refund is initiated no later than three business days, subject to the bank's processing time.

6.4. If damage is disputed or diagnostics are needed, the staff member draws up a preliminary report stating the reason for the check. The undisputed part of the deposit is refunded within the period in clause 6.3, and the calculation of the part withheld and the supporting materials are provided no later than ten calendar days.

6.5. Only documented amounts may be set off against the deposit: debt at the agreed price, the cost of a missing item, repair, transport for diagnostics in the cases provided for by law, and removal of extraordinary contamination beyond ordinary use. The balance is returned to the Lessee.

6.6. If the proven damage exceeds the deposit, the Lessee pays the difference. If the claims are less, the Lessor may not keep the balance as a penalty unless a separate lawful penalty has been agreed in advance.

7. Tobacco, charcoal and other consumables

7.1. Tobacco, hookah mixtures, charcoal, foil, mouthpieces and other consumables are not included in the set or the rental price, unless the Individual Order expressly states otherwise within the law.

7.2. The Lessee chooses and buys consumables separately. Buying tobacco or charcoal from Big Smoke is not a condition of the rental. The Lessor may require compliance with the manufacturer's objective requirements for compatibility and safe use of the equipment.

7.3. If the Lessee voluntarily buys consumables from Big Smoke, the sale is recorded on a separate receipt and governed by the retail sale rules. Tobacco products are handed over only to a person aged 21 or over, in closed, labelled consumer packaging.

7.4. The Lessor may prohibit the use of a particular material only where there is a justified risk of damage, fire, breach of the manufacturer's instructions or other mandatory requirements.

8. Handover of equipment and briefing

8.1. Handover and return take place at 21 Al-Farabi Avenue, non-residential premises 1177, Almaty, Kazakhstan, 050013, unless the parties have agreed another lawful procedure in writing.

8.2. In the presence of the Lessee or the Recipient, the staff member checks completeness and working order. For an electric heater, switching on and off, the heating surface, the cord, the plug and the integrity of the insulation are checked. For a hookah, the base, stem, tray, bowl, hose, mouthpiece, valves, balls, seals and joints are checked.

8.3. The staff member explains the rules for assembly, operation, safe heating of charcoal, switching off and return. The manufacturer's written instructions are handed over with the equipment or access to them is provided.

8.4. The condition may be confirmed by photos or video taken by the staff member and the Lessee. The file identifiers and comments are noted in the Record. If the Lessee declines to be photographed, they keep the right to record the condition themselves.

8.5. If the check reveals a fault or missing parts, this is noted in the Record or the equipment is replaced before handover. Signing the Record does not release the Lessor from liability for hidden or pre-existing defects.

9. Collection by an authorised person or courier

9.1. The Lessee may entrust collection to an adult authorised person or a courier by telling the manager in advance their full name, phone number and the order identifier. The Recipient shows the original document and the collection code, if one is used.

9.2. The Recipient inspects the set, takes part in the check and signs the section of the Record on actual receipt. The Recipient does not become the Lessee unless the parties separately arrange a substitution of the party to the agreement.

9.3. The risk to the equipment and the obligation to ensure its return pass to the Lessee when the set is handed to the Recipient named by them at the Big Smoke premises. The Lessee is answerable to the Lessor for the actions of the Recipient they chose and for the transport they arranged as for their own actions, unless the law provides otherwise.

9.4. Big Smoke is not a carrier and does not arrange delivery under this agreement. This does not release the Lessor from liability for the original completeness, working order and safety of the equipment handed over.

10. Rules of use

10.1. The Lessee uses the equipment only for its intended purpose, at the agreed place or within the agreed area and in accordance with the instructions. Taking it outside the agreed area is allowed only with the Lessor's prior written consent.

10.2. Subletting, transferring rights and obligations under the agreement, giving the equipment free of charge into the possession or use of a third party, dismantling, modifying, repairing it oneself and removing markings are prohibited. Additional users are allowed only with the Lessor's written consent and must be aged 21 or over.

10.3. The electric heater must be placed on a stable non-combustible surface, connected to a suitable mains supply, never left unattended and protected from water, impacts and open flame. The cord must not be stretched, pinched or wrapped around hot parts, and must not be allowed to scorch or have its insulation damaged.

10.4. The Lessee must stop using the equipment in the event of overheating, sparking, smoke, a smell of burning insulation, a damaged cord, a cracked base or any other sign of danger, switch it off safely and tell the manager immediately.

10.5. The Lessee complies with the statutory bans on consuming tobacco products in public and other places, fire safety rules and the rights of the owner of the premises. The equipment is not provided for an unlawful event or for use by minors.

11. Return and acceptance

11.1. The set is returned to a Big Smoke staff member at the agreed date, time and place. Handing it to building security, another shop or a taxi, or leaving the equipment without a staff member, does not count as a return unless the manager has agreed that method in writing.

11.2. On return, the staff member checks each item against the Handover Record and checks the integrity and operation of the equipment. The electric heater is checked for switching on, heating and switching off; the heating surface, cord, plug and insulation are inspected separately.

11.3. For a hookah, the staff member checks for new chips, cracks, deformation and tears, the completeness of the base, stem, tray, bowl, hose, mouthpiece, tongs, seals, balls and valves, and the presence of the bag or case and other listed accessories.

11.4. Ordinary signs of use and dirt removable by standard washing are not damage. Extraordinary contamination, odour or carbon deposits are taken into account only where the need for special work or replacement of a part is proven.

11.5. The results are recorded in the Return Record, with photos and video if necessary. The Lessee may be present, add comments and receive a copy of the Record.

12. Damage, loss and extent of liability

12.1. The Lessee is liable for loss, shortfall or damage if the Lessor proves a breach of obligations by the Lessee or persons chosen by them, the causal link and the amount of actual damage.

12.2. Possible breaches include lost accessories, a broken base or bowl, a torn hose, a deformed stem or tray, a lost ball or valve part, a damaged bag, a scorched or torn cord, damaged insulation and damage to the electric heater through improper use.

12.3. Compensation is calculated on the documented cost of repair or replacement of the missing part. If the whole device is lost or cannot be restored, its actual value, condition, wear and the value of any parts that remain are taken into account. The full price of a new set is not charged automatically.

12.4. The Lessee is not liable for original and hidden defects, ordinary wear, a fault arising without a breach of the instructions, or harm caused by an incomplete briefing, the actions of the Lessor or a circumstance for which the Lessee is not liable by law.

12.5. The Lessee's refusal to sign the Return Record is noted by the staff member. Such a refusal does not mean automatic acceptance of the claim and does not prevent the parties from using photos, video, correspondence, a diagnostics report and other admissible evidence.

13. Safety and the informational nature of the service

13.1. The rental concerns only the temporary use of equipment. It is not advertising, sponsorship, free distribution of tobacco products or a way of encouraging anyone to start or increase tobacco consumption.

13.2. Consuming tobacco products and hookah tobacco carries risks to life and health and can cause nicotine addiction. The Lessee decides independently whether to buy and use them in compliance with the law.

13.3. The Lessee accepts the ordinary risks of proper use of the equipment that have been explained in advance. This does not release the Lessor from liability for the working order, safety and completeness of the equipment and for complying with mandatory legal requirements.

14. Personal data and electronic records

14.1. To arrange and carry out the rental, the following may be processed: full name, date of birth or a note that the person is aged 21 or over, phone number, e-mail, document details to the extent necessary, the order identifier, payment details, and information about the Recipient, the set, periods, condition, photos and settlements.

14.2. The data is used for identification, communication, concluding and performing the agreement, accounting for property and the deposit, security, resolving disputes and complying with the law, in accordance with the Bigsmoke.kz personal data documents: the Privacy Policy and the Consent to the collection and processing of personal data.

14.3. The electronic rental card must keep the unique number, the version of the Terms, the agreed individual parameters, the time of actions, the confirmed phone number, photo identifiers, the Handover and Return Records and the history of changes, without unnoticeable replacement of previously confirmed data.

14.4. Photos are intended to record the equipment. Where possible, the staff member keeps faces and unrelated personal data out of the frame. Access is given only to authorised persons for the period necessary for the purposes of processing.

15. Refusal, termination and disputes

15.1. Before handover, the Lessor may refuse if there is no equipment, documents or required payments, or if there are grounds under clause 3.2. Amounts paid are refunded less only lawful and documented obligations.

15.2. The Lessor may require early return in the event of a material breach of the purpose, safety rules or the ban on transfer to third parties, or if there is a threat of loss or damage. The Lessee is notified before return is demanded, except in a situation of immediate danger.

15.3. Enquiries are sent to support. A written reply is given within the period established by law. The claims procedure does not limit the consumer's right to apply to a competent authority or a court.

16. Final provisions

16.1. These Terms apply from 1 September 2026. A new version applies to future orders and does not change individual terms already confirmed without the Lessee's consent.

16.2. The Individual Order, the Handover Record, the Return Record, the instructions and the confirmed electronic card form part of the particular agreement. In the event of a discrepancy, the individually agreed term applies, provided it does not breach mandatory rules and consumer rights.

16.3. The invalidity of an individual term does not terminate the remaining provisions. In matters not governed by the agreement, the legislation of the Republic of Kazakhstan applies.
