Bonus program

Effective from 1 September 2026

This Bonus Policy sets out the terms of the Big Smoke loyalty program and how bonus points are earned and used when buying permitted goods on the Bigsmoke.kz website and in participating Big Smoke boutiques. The program operates subject to the mandatory restrictions of the legislation of the Republic of Kazakhstan.

Key restriction of the program. Bonuses are neither earned on nor accepted as payment for tobacco and nicotine-containing products, heated tobacco products, hookah tobacco and mixtures, tobacco heating systems, or other goods whose promotion is restricted or prohibited by law. Such items are always paid for in full with money.

1. General provisions

1.1. The organiser of the program and the Seller is the individual entrepreneur Rustem Nurlanovich Mukhtarov, trading as IE «VR46», IIN 910605300019, hereinafter the «Seller», «we» or «Big Smoke».

1.2. The program is a voluntary system of bonus benefits for buyers. It is not a banking service, a payment system, a deposit, a lottery, a contest or a way of paying out money.

1.3. A participant may be a legally capable individual aged twenty-one or over who is registered in the program by phone number, through an account on Bigsmoke.kz or by another available means of identification set by the Seller.

1.4. Registering in the program, presenting a participant identifier, or earning or using bonuses means that you have read this Policy and accept its terms. Participation is free unless expressly stated otherwise before registration.

1.5. A bonus account is a technical record in the Seller's information system. Each participant may use one main bonus account, unless special terms provide otherwise.

2. Terms

2.1. A bonus or point is a notional unit of the program that entitles the holder to a discount on a later purchase of eligible goods. One bonus equals one point. A bonus is not money, electronic money or property, and cannot be exchanged for cash or non-cash funds, transferred to third parties or earn interest.

2.2. Eligible goods are goods for which the current terms of the program allow bonuses to be earned and/or used.

2.3. Excluded goods are goods for which bonuses are not earned and/or not used by virtue of the law, this Policy, the manufacturer's special terms or the current program settings.

2.4. The money part of a payment is the amount actually paid by the buyer in cash, by bank card or by another permitted monetary method after discounts and bonuses have been applied.

3. Current program parameters

3.1. Only full 50 tenge of the eligible part of a purchase count towards earning. A remainder of less than 50 tenge is rounded down and earns no bonus.

3.2. The value of the eligible part is determined after discounts, promo codes and other price reductions, and excluding the amount paid with bonuses. For example, paying 249 tenge in money for eligible goods earns 4 points.

3.3. In a mixed order, points are calculated separately on the eligible items. The price of excluded goods does not count towards points and cannot be reduced with bonuses.

4. Goods taking part in the program

4.1. The list is by category, not by brand. ENZO, X KAH and other names are given only to identify goods; whether a particular model or item takes part is determined by its actual category and its flag in the system at the time of purchase.

4.2. Goods whose circulation is prohibited by the legislation of the Republic of Kazakhstan do not take part in the program and are not sold by the Seller. If the legal regime of a category changes, the relevant restriction applies from the moment it became mandatory, regardless of how the program displayed it before.

4.3. The Seller may exclude from earning or redemption individual eligible goods, sets, new arrivals, goods at a special price, gift certificates, delivery services or the items of a particular promotion. Any such restriction must be visible to the buyer before payment is confirmed.

5. Earning bonuses

5.1. To earn bonuses, the participant must, before payment is completed, sign in to their account on Bigsmoke.kz or give the cashier their phone number or present another valid program identifier.

5.2. Bonuses are credited after the order has been paid in full and may become available after the goods are handed over, the order is closed or a technical processing period has passed. The exact moment is shown in the personal account or given by support.

5.3. Bonuses are not earned on the money part paid for excluded goods, delivery, fees, packaging, a gift certificate or other related services, unless stated otherwise before payment.

5.4. Special offers on eligible goods may carry an increased or fixed earning. Where the terms of a promotion differ from this Policy, the special terms apply to the purchase concerned to the extent of the difference.

5.5. Bonuses are not credited retrospectively if the participant did not identify themselves before payment was completed, except in the case of a technical error confirmed by a receipt and approved by the Seller.

6. Using bonuses

6.1. Bonuses may be used only by the participant on whose bonus account they are recorded, after identification and within the available balance.

6.2. Before payment is confirmed, the buyer is shown the amount available for redemption, the value of a point applied, the eligible items and the resulting money part. Confirming payment means agreeing to apply these parameters to the purchase.

6.3. After bonuses are applied, the buyer must pay at least 10 tenge in money per order or receipt. If excluded goods or other mandatory payments add up to more, they are paid in full in addition.

6.4. Bonuses cannot be used to pay out cash, to transfer to a bank account, to pay off a debt for an earlier purchase, to buy a gift certificate or to pay for a third party's goods outside the procedure set by the Seller.

6.5. Bonuses may be combined with promo codes, discounts and special prices where the website interface or the till allows it for the particular purchase.

7. Returns, cancellations and adjustments

7.1. When an order is cancelled or eligible goods are returned, the bonuses earned on them are cancelled. On a partial return, the number of points relating to the returned part of the purchase is adjusted.

7.2. If bonuses were used for the purchase, money is refunded up to the amount actually paid in money for the returned goods. The bonuses used are restored to the bonus account if they are still valid and the return is permitted by law and the terms of sale.

7.3. If the bonuses earned on a returned purchase have already been used, the Seller may deduct an equivalent number from the available balance or make another proportionate adjustment, without reducing the mandatory money refund due to the buyer.

7.4. A refusal to accept the return of goods under the law, a contract or the applicable return rules does not in itself give a right to monetary compensation for bonuses.

8. Dynamic terms and changes to the program

8.1. The program is dynamic. The Seller may, going forward, change the earning rate, the value of a point when redeemed, the maximum share payable with bonuses, the minimum money part, the validity of points, the list of participating goods and outlets, the identification procedure, compatibility with discounts and the terms of special offers.

8.2. The current parameters are published on Bigsmoke.kz, in the personal account, in the checkout interface, at the till, in the boutique's information materials, or communicated by another available means. A particular purchase is governed by the parameters shown to the buyer before it is confirmed.

8.3. Changes do not recalculate the price of a completed purchase or cancel the discount given on it. Accumulated points are used under the rules in force on the date they are redeemed.

8.4. Changes that significantly affect the use of accumulated points are published a reasonable time before they apply, except where an immediate change is needed to comply with the law, prevent abuse, fix a technical error or protect the information system.

8.5. The Seller may suspend or end the program. Where possible and not contrary to the law, participants are given a reasonable time to use valid points on eligible goods. Unused points are not compensated in money.

9. Technical errors and abuse

9.1. During a technical failure, earning or using bonuses may be temporarily unavailable. After checking, the Seller may restore the correct balance on the basis of system data, the cash-register or electronic receipt and the payment information.

9.2. The Seller may correct bonuses that were credited, redeemed or displayed in error. The participant may ask for an explanation and submit supporting documents to support.

9.3. Creating fictitious purchases, using someone else's number without permission, combining several accounts to get round restrictions, automated accumulation, selling bonuses and other actions aimed at gaining an unjustified advantage are prohibited.

9.4. Where there are reasonable signs of abuse, the Seller may temporarily restrict transactions on the bonus account while it checks, cancel bonuses obtained improperly, or end participation. Such measures do not limit the buyer's mandatory rights under the sales agreement.

10. Personal data

10.1. To run the program, the Seller processes the data needed to identify the participant, keep the bonus account, record transactions, prevent abuse and deal with enquiries, including the name, phone number, and details of the account, purchases and bonus transactions.

10.2. Processing is carried out in accordance with the legislation of the Republic of Kazakhstan, the Consent to the collection and processing of personal data and the Bigsmoke.kz Privacy and Consumer Personal Data Processing Policy.

10.3. Taking part in the program does not automatically mean consenting to advertising messages. Advertising mailings are sent only where there is a separate lawful basis and can be stopped by an available means.

11. Final provisions

11.1. This Policy forms part of the rules for dealing with buyers when the program is used. Matters of sale, payment, delivery, warranty and returns are governed by the relevant public offer, retail sales agreement and the legislation of the Republic of Kazakhstan.

11.2. Nothing in this Policy is intended to advertise or encourage the consumption of tobacco, nicotine or other products whose promotion is prohibited or restricted by law. If the technical display of the program conflicts with a mandatory legal requirement, the law applies.

11.3. If any provision is found invalid or unenforceable, the remaining provisions continue to apply to the fullest extent permitted by law.

11.4. This Policy and the relations of the parties are governed by the legislation of the Republic of Kazakhstan. Enquiries and disputes are dealt with in the manner provided by law and the Bigsmoke.kz documents.
